These terms are an agreement between you (the "Customer") and Fast Response ("Fast Response", "we", "us"), based in Vernon, British Columbia. They cover your use of the Fast Response lead-capture widget and related services (the "Service"). By installing the Service or paying for it, you agree to these terms.
1. What the Service does
Fast Response provides a small piece of code you add to your website. When a visitor submits the form, we send you their contact details by text message and store the submission so you can follow up. We set up and configure the Service for you and help you confirm it is working.
2. Fees and billing
- The Service is provided for a one-time setup fee plus a recurring monthly subscription, at the rates confirmed with you when you sign up. As of the date above, the standard rate is a $99 CAD one-time setup fee plus $49 CAD per month. Promotional rates may apply and will be confirmed at signup.
- The subscription is billed monthly in advance to the payment method you provide, and renews automatically each month until cancelled.
- Fees are exclusive of any applicable taxes.
3. Cancellation
There is no long-term contract - you may cancel at any time by contacting us, and your subscription will end at the close of the current billing month. After cancellation the Service stops working and you may remove the code from your site (or we will confirm it has been deactivated).
4. Refunds
The setup fee is non-refundable once the Service has been installed and tested. Monthly subscription fees already paid are non-refundable, but you will not be billed for any month after you cancel.
5. Your responsibilities
- You confirm you are authorized to add code to the website where the Service is installed.
- You are responsible for how you contact and handle the leads you receive, including complying with applicable laws (for example, anti-spam and telemarketing rules).
- You are responsible for maintaining an appropriate privacy notice on your own website for visitors who submit the form.
6. License to use the Service
Fast Response grants you a limited, non-exclusive, non-transferable license to use the Fast Response widget and related hosted services on the approved website or websites we configure for you. You do not receive ownership of the widget code, backend systems, documentation, designs, trademarks, brand assets, or any other Fast Response intellectual property.
7. Restrictions
You agree not to:
- copy, clone, resell, sublicense, or redistribute the Service except as expressly allowed in writing by Fast Response;
- reverse engineer, decompile, scrape, modify, or recreate the widget, backend, workflows, or documentation for a competing product or service;
- remove, hide, or alter Fast Response notices, identifiers, security checks, or tracking built into the Service;
- use the Service to send spam, abusive submissions, unlawful content, or misleading lead information;
- share account credentials, API keys, installation snippets, or backend access with anyone who is not authorized to manage your website or account.
8. Agency and partner use
Agencies and partners may offer Fast Response to their own clients only under partner terms approved by Fast Response. Unless we agree otherwise in writing, agencies may not white-label, rebrand, resell, bundle, copy, or recreate the Service as their own product. Partner clients remain subject to these terms, and each client installation must use approved configuration details and approved website domains.
9. Fast Response brand and materials
The Fast Response name, logo, website, widget design, install materials, sales materials, and related copy are owned by Fast Response or licensed to us. You may use materials we provide only to install, describe, or promote the Service in the way we authorize. You may not use Fast Response branding in a way that suggests ownership, endorsement, or partnership beyond what we have agreed to in writing.
10. Suspension or termination for misuse
We may suspend or terminate the Service if we reasonably believe it is being used in a way that violates these terms, threatens the security or reliability of the Service, infringes our rights, harms visitors or contractors, or may create legal risk. Where practical, we will contact you first so the issue can be fixed quickly.
11. Leads and data
The details a visitor submits (such as name, phone number, email, and message) belong to you. We process that information on your behalf to deliver and store the lead, using trusted service providers - currently Twilio (text message delivery) and Airtable (storage). We do not sell your data or your leads, and we do not use them for any purpose other than providing the Service. Our handling of this information is described in our Privacy Policy.
12. Service availability
We work hard to keep the Service running and to deliver every lead promptly. However, the Service depends on third parties (such as mobile carriers and our hosting and messaging providers), and we cannot guarantee uninterrupted service or that every single message will be delivered. The Service is provided "as is." We recommend you also keep an eye on your stored leads as a backup.
13. Limitation of liability
To the extent permitted by law, Fast Response is not liable for any indirect or consequential losses, including lost business, lost leads, or lost revenue. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the three months before the claim.
14. Changes
We may update the Service or these terms from time to time. If we make a material change, we will let you know by email or on this page. Continuing to use the Service after a change means you accept the updated terms.
15. Governing law
These terms are governed by the laws of British Columbia and the applicable laws of Canada.
